Ministerial Decree No. 228 validating the Regulation on modalities of licensing and regulating of subsoil management.

This Ministerial Decree establishes the modalities of licensing and regulating of subsoil management. The right of subsoil management shall be fulfilled in accordance with licence that shall be issued by the state licensing authority. Subsoil management (mining) shall be performed in accordance with the following modalities: (a) for mineral deposits of national significance – through tenders; (b) for other categories of deposits – through auction sale; (c) in case of double invalidation of the outcome of tender or auction – through direct negotiation; and (d) in case of artisanal mining – through registration of authorization by local government.
