Résumé

The Ministerial Decree regulates relations concerning registration and use of the place of origin of commodities. It consists of 11 Sections dealing with the following matters: basic provisions (Sect. 1); registration (Sect. 2); examination of the application (Sect. 3); appeal of a decision (Sect. 4); registration of the place of origin and issuing of certificate (Sect. 5); amendment of the certificate of the place of origin (Sect. 6); registration of the place of origin of commodities abroad (Sect. 7); use of the place of origin (Sect. 8); cessation of the legal protection of the place of origin (Sect. 9); dispute settlement and liability (Sect. 10) and legal rights of the foreign legal entities and natural persons (Sect. 11). National Patent Information Centre is the authorized institution registering and granting the right of use of the place of origin of commodities which includes geographic denomination. Registered place of origin of commodities shall be open-ended. Application must contain the following: (a) application form; (b) the declared name of the place of origin; (c) the type of commodity with the indication of the geographic boundaries; (d) decision of the competent body that the applicant is located in a given geographic area characterized by particular natural properties; (e) certificate of origin for the foreign applicants and (f) certificate of payment of dues and fees. Patent authority registers the places of origin of commodities in the state register. Certificate of the right of use of the place of origin shall be valid for ten years and is subject to prolongation for one or more ten-year periods.
