Résumé This Act sets forth provisions on (i) inspection of mines, (ii) mineral rights, (iii) procedures of reconnaissance licence, exclusive prospecting licence and mining licence, (iv) liabilities and duties of licence holders, (v) renewal, amendment, surrender, cancellation, suspension, transfer and registration of mineral rights, (vi) compliance with conditions of mineral right for protection of environment, (vii) reserved minerals, (viii) restrictions on surface rights, and (ix) establishment, duties and structure of the Board for dispute settlement. This Act shall apply to all minerals in any land in Belize, under territorial sea as determined by the maritime legislation in force, on or under the sea bed beyond the territorial sea to a point where the sea is two hundred metres in depth and beyond to such depths of the adjacent waters as admit of exploitation of minerals, as well as in suspension or in solution in any spring, stream, river, lake, lagoon or in the sea. The Minister may grant to any person a permit to export minerals from Belize on conditions determined by the Minister and specified in the permit; but the grant of such a permit does not exempt the person concerned from complying with the requirements of any other law relating to the export of minerals. The Minister may make regulations prescribing all matters that by this Act are required or permitted to be prescribed or are necessary or convenient to be prescribed for carrying out or giving effect to the provisions of this Act. Submission of records and reports by the holders of reconnaissance licences, exclusive prospecting licences and mining licences are specified in the First Schedule.
