Résumé

This Act sets regulation on the appropriate exploitation of mineral resources (exploitation of subsoil for storage; energy production from water, wind and underground resources) and the establishment and management of pipelines for oil, natural gas and hydrocarbons on land territory, the territorial sea around Greenland, the continental shelf area and the exclusive economic zone of Greenland. Permission and approval of the mentioned activities shall be granted only when an assessment of the Environmental Impact Assessment (EIA) for their execution is carried out and reported to the Government authorities. An emergency committee responsible for coordinating regulatory efforts in accident and emergency situations, including war situations on offshore installations, shall be established. The Act applies to safety, health, environment, resource utilization and social sustainability recognized international practices through the implementation of guidelines set by the Greenlandic government. Regulations on environmental protection shall be taken in consideration for the preservation of animal, human and plant life and liability shall be put onto the responsible entities creating environmental pollution. The Geological Survey of Denmark and Greenland (GEUS) and the National Environmental Research Institute (NERI) may conduct research of particular relevance to mining exploration in Greenland. Safety zones around offshore installations and accommodation vessels shall extend to 500 meters. Authorization on exploitation for research shall be subject to a length of 10 years’ period with a maximum of 16 years for special cases. Extension of authorization may take place 3 years at a time. These authorizations are entitled to an extension of the license for commercial exploitation purposes for a period of 30 years. The Government shall grant permission for the exploitation of subsoil for storage and for a period of up to 50 years. If necessary, authorization for storage of air or gases may be granted for a specified longer period. Geological, geophysical, glaciological, hydrological and other studies for scientific purposes must be carried out under a license granted by the Government, which can implement payment of costs associated with these activities and in accordance to regulations of the Commission for Scientific Research in Greenland (Inuit Circumpolar Conference).
