This Law entered into force on 1 May 1993.
Résumé

The purpose of the Act is to ensure production safety and to prevent accidents in mines, as well as to promote the development of the mining industry. The Law consists of 50 articles divided into 8 Chapters: General Provisions (I); Guarantees for Safety in Mine Construction (II); Guarantees for Safety in Exploitation of Mines (III); Safety Management of Mining Enterprises (IV); Supervision and Control over Safety in Mines (V); Disposition of Accidents at Mines (VI); Legal Liabilities (VII); Supplementary Provisions (VIII). The competent department of labour administration under the State Council shall exercise unified supervision over the work of safety control throughout the country (art.4). The State encourages research in science and technology relating to safety in mines, popularizes advanced technology, improves safety facilities and enhances the level of safe production in mines (art.5). The design papers for mine construction projects must comply with the safety rules and technological standards for mining industry and shall be subject to the approval of the authorities in charge of mining enterprises (art.8). For exploitation of mines, requirements that ensure safe production must be met, and the safety rules and technological standards for mining industry corresponding to the exploitation of different types of minerals must be observed (art.13). Chapter IV deals with safety management in mining enterprises; Chapters V and VI set out duties for the supervision and control of mining safety as well as rules and procedures for handling mining accidents. The Law includes specific penalties for non-compliance.
