They shall apply to offshore facilities and pipelines. Harbour authorities and operators of facilities shall have an oil pollution emergency plan in accordance with these Regulations. Such plan shall be approved by the Minister. A plan must be altered if not conform to the National Contingency Plan or if not appropriate for dealing with oil pollution incidents. Only activities regrading oil may be undertaken if they are subject of an oil pollution emergency plan. Every operator of an oil handling facility that— is a pipeline; or would be an offshore installation were it in offshore waters, must ensure that no activities that present a risk of an oil pollution incident are undertaken, unless those activities are the subject of an oil pollution emergency plan approved by the Minister, under this Regulation. The Regulations also require operators or masters of ships to report to the Minister on the discharge of oil in marine waters, provide for inspection of installations, and define offences.
