Résumé

The Maritime Ordinance 2017 of the Falkland Islands makes comprehensive provision for various aspects of merchant shipping, dumping and deposits at sea, Admiralty jurisdiction, and international conventions. The document is divided into 15 parts, each covering a different topic related to maritime matters. The first part contains preliminary provisions such as definitions, interpretation, and persons qualified to own British ships. The registration of British ships in the Falkland Islands. Part 2 deals with the registration requirements, entitlements, and offences for British ships in the Falkland Islands. It specifies who can register a ship, what are the proper national colours, and what are the penalties for carrying improper colours or concealing the nationality of the ship. The registration regulations and procedures. Part 3 provides for the making of registration regulations by the Governor, the maintenance of the register by the Registrar, the application and declaration process, the issue and cancellation of certificates of registration, and the termination of registration. The document applies to all ships used in navigation, including fishing vessels (Part 6), government ships, and foreign ships, as well as to persons involved in maritime activities, such as owners, masters, seafarers, salvors, and receivers of wreck. Part 7 talks about the prevention of pollution from ships and other sources. The Part is organized in Chapters; Waste reception facilities at harbors: oil pollution and liability for oil pollution; carriage of hazardous and noxious substances. The Governor can make regulations to give effect to various international conventions or treaties that aim to prevent, reduce or control marine pollution by matter from ships (section 131 and section 132). The Governor can also make regulations to prevent or reduce pollution from offshore installations, submarine pipelines, dumping of waste and other activities (section 133). The Governor can take measures to respond to incidents that cause or may cause marine pollution, and may agree to indemnify or charge other persons who take such measures (section 290). The Governor can also dispense with certain requirements or prohibitions relating to the prevention of pollution in certain circumstances. the Ordinance also provides for dumping and deposit at sea and licence requirements.
