Résumé

The overall purpose of this Act, consisting of 100 sections divided into 15 Parts and completed by one Schedule, is to protect the Territory's marine and coastal environment by minimising intentional and negligent discharges of ship-sourced pollutants into coastal waters (sect. 5). This purpose is to be achieved by implementing the provisions of the International Convention for the Prevention of Pollution from Ships, MARPOL. The Act concerns in particular pollution from oil (Part 2), pollution by noxious liquid substances in bulk (Part 3), packaged harmful substances (Part 4), sewage (Part 5), garbage (Part 6) and pollution during transfer operations (Part 7). Section 50 establishes a duty to report incidents involving polluting substances. Part 10 of the Act is dedicated to enforcement and provides for the appointment of officers, their functions and powers. The Act also covers offences in relation to enforcement (Part 11), the power to intervene if maritime casualty (Part 12), damage and compensation (Part 13) and offences and proceedings (Part 14).
