However, the Act's operation has been suspended for the State of Sarawak from 1 May 2001. Résumé The Act provides for the establishment of the Energy Commission which is hereby empowered to regulate the energy supply activities in Malaysia and to enforce the energy supply laws. The Act is composed of six Parts, as follows: (I) Preliminary; (II) Energy Commission; (III) Functions and Powers of Commission; (IV) Officers of the Commission; (V) Finance; (VI) General. Details as regards the powers and functions of the Commission are given in Section 14. In particular, the Commission shall: (a) advise the Minister on all matters concerning the national policy objectives for energy supply activities; (b) advise the Minister on all matters relating to the generation, production, transmission, distribution, supply and use of electricity as provided under the electricity supply laws; (c) implement and enforce the energy supply laws; (d) regulate all matters relating to the electricity supply industry and to protect any person from dangers arising from the generation, production, transmission, distribution, supply and use of electricity as provided under the electricity supply laws; (e) promote efficiency, economy and safety in the generation, production, transmission, distribution, supply and use of electricity; (f) promote the use of renewable energy and the conservation of non-renewable energy; (g) promote research into, and the development and the use of, new techniques relating to the generation, production, transmission, distribution, supply and use of electricity; (h) review the energy supply laws and make the necessary recommendations to the Minister. A special fund, to be administered and controlled by the Commission for achieving the above-mentioned objectives, is established under Section 24. As regards offences, no prosecution shall be instituted for any offence under this Act without the written consent of the Public Prosecutor.
