Part 3 of this Act commences on the day on which it is published in the Gazette and the other Parts of this Act commence on a date to be prescribed by the Minister by Order.
Résumé

This Act lays down rules for the obligation of the livestock operator to comply with prescribed livestock management standards and to carry out systematic risk assessment, content of the systematic risk assessment of the likely risks to animal welfare and biosecurity arising from the regulated livestock management activity, and declaration of intention of the Minister to prescribe a livestock management standard in Part 2; and the establishment, functions, powers and composition of the Livestock Standards Committee in Part 3. Furthermore, Part 4 sets forth provisions on the exemptions for a livestock operator who carries out a regulated livestock management activity under an approved compliance arrangement; application, approval and content of compliance arrangement; monitoring of compliance with the terms of each approved compliance arrangement; and amendment, revocation or suspension and audit of approved compliance arrangements. The powers of the Minister to approve forms and guidelines relating to any requirement of this Act or the Regulations made under this Act are set out in Part 5. Appointment, certification, functions and powers of inspectors of livestock; power to enter and inspect with consent; power to enter and inspect with search warrant; power to search, inspect or examine; power to require documents and information; power to take samples from any livestock, livestock product or fodder for examination; further powers of the inspector; offences and penalties; and court proceedings are laid down in Part 6. Moreover, in a situation where there is a threat or existence of an outbreak of infectious exotic livestock disease that poses an immediate risk to animal welfare, human health, biodiversity or biosecurity, inspector must inform the occupier of that place about the emergency and if required, enters that place and exercises all or any powers without a warrant. A person who engages in a regulated livestock management activity and acts in a manner that results in a serious risk to human health, animal welfare, biosecurity, environment and biodiversity, or the spreading of disease, shall be punished for this offence. Lastly, Part 7 sets forth miscellaneous provisions such as protection of information supplied to inspectors and commencement. The Minister, on the advice of the Livestock Standards Committee, may make Regulations consistent with this Act for the better carry out or giving effect to the provisions of this Act.
