Résumé

This Act makes provision with respect to licensing of services in the utility sector and provides with respect to matters related to such licensing. A person shall not supply or use, or cause or permit to be used, any apparatus for the purpose of supplying, any premises with any utility services except under and in accordance with the terms of a licence granted under this Act by the Governor. A licences may be granted to: (a) generate, transmit, distribute or supply electricity; (b) prospect or harness geothermal power or any other source of energy; (c) collect, treat, distribute or supply piped drinking water; or (d) collect, treat or dispose of waste water and sewage. The Act provides for securing compliance with licence conditions by a licensee and prescribes a penalty for supplying utility services unlawfully. It also, among other things: defines rights, powers and duties of a licensee; defines various offences; provides for appeal; prohibits the felling of trees that may constitute a danger to any works.
