Résumé

The Civil Protection Code defines the scope and functions of the National Civil Protection Service. The scope is protecting life, physical integrity, property, settlements, animals and the environment from damage or danger of damage from events disasters of natural origin or deriving from human activity; its functions are those aimed at predicting, preventing, mitigating, and managing the risk of emergencies and overcoming them. Art. 7 defines the "Types of civil protection emergency events" as 1) events that can be managed by single administrations with ordinary powers, 2) events that require coordination of more than one administration and use of extraordinary powers 3) nationwide emergency events that requires the use of extraordinary measures and powers. A. 16 lists the types of risks that generally require intervention of Civil Protection, follow: seismic, volcanic, from tsunami, hydraulic, hydro geological, meteorological phenomena adverse, water deficit and forest fires, chemical, nuclear, radiological, technological, industrial, from transport, environmental, sanitation and uncontrolled return of objects and space debris. Section IV lays down the discipline for managing nationwide emergency events; Art. 24 clarifies the process for a State of Emergency Declaration, Art. 25 identifies in the Chief of the Civil Protection Order the instrument that should be used in a situation of nationwide emergency ("to be adopted, notwithstanding any current provision of law and indicating sections and reasons that it derogates, in respect of the limits and formalities established by the Resolution declaring the state of emergency, in agreement with Region and Autonomous provinces), and the following articles set the discipline on budgeting and post emergency measures.
