This text entered into force eight days after its publication in the Official Gazette (published on 30 December 2019).
Résumé

This Law regulates the rules of public procurement procedures for concluding contracts or framework agreements on public procurement of goods, works or services, protection of rights in public procurement procedures and other issues of importance for public procurement. Obligors for the application of this Law are public contracting authorities and sectoral contracting authorities. The public contracting authority is: 1) state body; 2) local self-government unit; 3) public service, i.e. a company that: has the status of a legal entity, was established to satisfy needs of public interest, which does not have an industrial or commercial character, in which the state and/or local self-government unit owns more than 50% of shares or shares or which is financed with more than 50% from the budget of Montenegro and/or the budget of the local self-government unit and other public revenues or over which control is exercised by the public contracting authority or which has more than half of the members of the management body or supervisory body appointed by the public contracting authority; 4) an association, that is, an organization founded by two or more clients. Sector ordering party is: 1) a public contracting authority that performs one of the sectoral activities established by this Law, 2) a business company in which the public contracting authority has a predominant influence, and which performs sectoral activities, or 3) another economic entity that performs sector activity on the basis of special or exclusive rights granted to them by the competent state authority or the competent authority of the local self-government unit. Chapter XIII sets penalty provisions.
