Résumé The purpose of this Law shall be to regulate import, transportation, storage and trade of petroleum products on domestic market, and to specify terms and conditions for the aforesaid activities. Its scope shall be to ensure national energy security. The Law consists of eight Chapters composed of 25 articles dealing with the following matters: general provisions (Chapt. 1, arts. 1 - 5); competence of public administration (Chapt. 2, arts. 6 – 10); issuance of licences and technical requirements (Chapt. 3, arts. 11 – 14); import and export (Chapt. 4, arts. 15 and 16); transportation and storage (Chapt. 5, arts. 17 and 18); trade (Chapt. 6, arts. 19 – 21); data collection, reporting and dispute settlement (Chapt. 7, arts. 22 and 23); transitional and final provisions (Chapt. 8, arts. 24 and 25). Participants in petroleum products market shall be licensees and holders of technical authorization. The Law sets forth quality standards for petroleum products to make them compatible with environment. National Energy Regulatory Agency shall be authorized to issue fee-based licences for a period of five years. The following activities shall be subject to licensing: (a) import and wholesale trade of petroleum products; (b) retail trade of petroleum products; (c) import and wholesale trade of liquefied gas; (d) retail trade of liquefied gas. The following activities shall be subject to technical authorization: (a) operation of storage facilities of petroleum products; (b) operation of petrol and gas stations; (c) operation of special transpiration facilities. Storage facilities must pass environmental audit. Safety of petroleum products for public health, consumer property and environment is guaranteed by the quality of these products, regulated by regulations acts.
