Résumé

This Law regulates relations in the field of environmental security in the process of performance of economic and other activities by legal and natural persons and is aimed at ensuring the vital interests of man and society, protecting the environment from the danger arising from anthropogenic and natural impact on it. Environmental security shall be based upon the following principles: (a) the supremacy of constitutional human rights to environmental security; (b) the creation and maintenance of the national system of environmental security as mandatory condition for the implementation of state strategy for sustainable social and economic development; (c) responsibility of public authorities and local self-government bodies, public associations, other legal entities and individuals for ensuring environmental safety in the relevant territory; (d) insurance of environmental risks; (e) compulsory insurance of civil liability of enterprises and industries that are a source of increased environmental risks; (f) independence of the environmental audit from economic and other activities; (g) location of economic and other activities (anthropogenic objects and natural-anthropogenic objects) on the basis of the results of the state environmental audit; (h) compulsory compensation for damage caused to the environment, public health, property of natural and legal persons; (i) restrictions on the performance of any type of activity and (or) suspension of activities that represent risks to environmental security; (j) access information in the field of environmental security; (k) liability of legal and natural persons for risks to environmental security; (l) public participation in elaboration and implementation of decisions affecting their rights to a favorable environment and ensuring environmental security; and (m) development of international cooperation in the field of environmental security. "Article 29-1. Monitoring of the ecological state in zones of ecological emergency and zones of ecological disaster. 1. Monitoring of the ecological state in zones of ecological emergency and zones of ecological disaster includes special observations and relevant studies of the state of the environment and public health. 2. The objects of monitoring the ecological state in zones of ecological emergency and zones of ecological disaster include: (a) factors that led to the emergence of emergency environmental situations and environmental disasters; and (b) negative changes in the state of the environment and public health in the territory of the zone of emergency ecological situation or zone of ecological disaster, as well as in the territories adjacent to them, including the quality of atmospheric air, surface and ground waters, soil, radiological indicators and biological diversity. Article 29-2. Research work in zones of ecological emergency and zones of ecological disaster can be carried out in the field of: (a) scientific assessment of the results of the negative impact of economic and other activities on the environment; (b) evaluation of forecasts in the field of prevention and liquidation of emergency situations in zones of environmental emergency; (c) scientific study of the impact of negative environmental phenomena in areas of ecological disaster on public health, the level of infectious and non-infectious diseases that occur among people and animals; (d) determining the hazard class of objects that adversely affect the atmospheric air, as well as studying the negative impact of dust and salt aerosols on public health and the environment; (e) conducting comparisons on the qualitative and chemical composition of drinking water and food products in zones of environmental emergency and environmental disaster zones; and (f) assessment of the state of health of the population in the zones of emergency ecological situation and zones of ecological disaster.”
