Résumé

This Act prohibits the production for distribution of electricity or drinking water, except for own use and in case of emergency, without an authorization of the Minister (The Minister for Economic Affairs and Climate for electricity and the minister of Infrastructure and Environment for drinking water). The authorization can be given to an operator for maximum 15 years and may be changed, or suspended by the Minister. The Act sets out the duties and obligations of producers and distributors of electricity or water. Authorizations may be changed when requirements of supply of water or electricity change and may be cancelled in case that a producer does not meet the conditions sets out in this Act or made under this Act. A distributor of electricity or water must be appointed by the Minister. This appointment can also be changed or cancelled. Our Minister of Infrastructure and the Environment determines the main points and principles of the policy for the implementation of this Act for drinking water. This includes at least the production and distribution of drinking water and the security of a reliable and sustainable public drinking water supply. The act requires further regulation of measures in case drinking water does not meet quality standards as mentioned in this Act. The Act also provides for enforcement ad dispute resolution. The Authority for Consumers and Markets shall be the general supervisory body for purposes of this Act.
