This Law enters into force on 1 March 2010.
Résumé

The purpose of this Law is to conduct competitive tenders for the allocation of state and local property to investors under concession agreements, to regulate relations regarding concession agreements, their stipulation, modification, termination, and dispute resolution. Unless otherwise specified in the concession agreement, the ownership, use, and ownership rights of newly constituted property transferred in accordance with the procedures stipulated in this Law shall be related to the acquisition of state or local property and registration in the state register. Concession shall be intended the exclusive right to own, use, create new, or improve state or local property on the basis of a contract in accordance with the conditions and procedures specified in this Law for the purpose of providing infrastructure and basic social services to the public. The ownership of the concession item and its parts and equipment shall be regulated by the concession agreement, and they may be classified in the agreement as follows: (a) property to be transferred to state or local ownership or to other persons according to the concession agreement; (b) property that can be purchased by the state or local government from the concession holder; and (c) property that the concessionaire may retain and dispose of after the termination of the concession agreement. The state may provide the following types of financial support to concessionaires: (a) issue a loan guarantee; (b) release a certain part of concession financing; (c) preferential taxation and other financial support; (d) insurance coverage; (e) guarantee the minimum income of the concessionaire under the concession agreement; and (f) provide compensatory benefits if stipulated in this law and the concession agreement.
