Résumé This Act lays down the fundamental principles of property law, possession and rights in rem (limited property right that is an absolute right), as well as the acquisition, transfer, protection and extinguishment of such rights. Immovable property is a spatially defined area of land together with all its components. Rights in rem shall include the following: ownership right; lien; easement; right of encumbrance; right of superficies. Whoever acts in a fair way during the course of legal transactions and relies on the data, which has been entered in the land register with regards to rights, shall not suffer any damaging consequences. The owner of a thing or the holder of other rights in rem shall be restricted by the same rights of other persons. The ownership right and other rights in rem should be exercised in accordance with the basic principles of this Code and in accordance with the purpose and the nature of things.
