It provides that import, export and transit of any kind of waste shall be prohibited in the territory of Georgia (including its territorial waters, airspace, continental shelf and special economic zone) unless otherwise directly indicated by this Law. The following shall be prohibited in the territory of Georgia: a) the import and transit of hazardous waste; b) the import of non-hazardous waste for the purposes of its disposal; c) the export of hazardous waste, unless: c.a) the state where hazardous waste is exported to is not a member of the Basel Convention; or officially prohibits the import of such waste; and c.b) there is a written consent of a competent authority (ies) of the importing and/or transiting state(s). The Law further provides for permitted categories of waste, definition of hazardous and non-hazardous waste as provided under the Basel Convention of 22 March 1989 on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, and issuance of permits for permissible import, export and transit of waste.
