Résumé The purpose of this Law is to regulate relations in the field of legal protection and use of geographical indications. This Law does not apply to relations in the field of legal protection and use of appellations of places origin of goods. A geographical indication is a sign that identifies the product as originating in the territory of a certain geographical feature where quality, reputation or other characteristics of the goods to a large extent depend on its geographical origin. In the territory of a given geographical object, at least one from the stages of production of goods, which has a significant impact on the formation of product characteristics. A person who has registered a geographical indication is entitled to use of it, if this person produces a product of a certain quality, reputation or other characteristics of which are largely depend on its geographical origin. The right to use a geographical indication registered in the manner prescribed by this Law, may be granted also to another legal or natural person who is located in the same geographical area and producing goods with the same characteristics. Authorized state body in the field of legal protection of geographical indications is the Agency for Intellectual property under the Ministry of Justice of the Republic of Uzbekistan. A geographical indication can be registered on application submitted by several legal entities or natural persons (in exceptional cases one person, if there are no others, or they do not express a desire to participate in the application) located in a given geographical area whose name is used to refer to the goods produced thereby. An application for the registration of a geographical indication can be filed also by: (a) non-governmental non-profit organization established in the form of an association authorized to represent the interests of legal and (or) natural persons; and (b) executive authority at the local level, on the territory of which the corresponding geographical area is located.
