Entry into force notes
This Law enters into force one month after the date of its official publication.
Résumé

The scope of this Law shall be to regulate public-private partnership relations. It shall not be applicable to production sharing agreements and to the sphere of public procurement. Public-Private Partnership shall be intended cooperation between a public partner and a private partner, based on the unification of their resources for the implementation of a public-private partnership project, which is legally formalized for a certain period of time. The main principles of public-private partnership shall be as follows: (a) equality before the law of the public partner and private partner; (b) transparency of rules and procedures in the implementation of public-private partnership; (c) competitiveness and objectivity in the selection of a private partner; (d) non-discrimination; and (e) inadmissibility of corruption. The main directions of the state policy in the field of public-private partnership shall be as follows: (a) stimulating economic growth and ensuring sustainable development of the Republic of Uzbekistan; (b) development, approval and implementation of state programs in the field of public-private partnership; (c) assistance in formation, restoration, operation, maintenance of existing public infrastructure; (d) improving the quality of operation and maintenance of public infrastructure; (e) improving the quality of public services and expanding access to them; (f) creation of conditions ensuring attraction of financial resources from the private sector, including foreign investments; and (g) state support for scientific research, introduction of modern methods and technologies to develop and improve the institutional and legal framework of public-private partnership. This Law contains X Chapters divided into 44 Articles. Chapter I lays down general provisions. Chapter II regards state regulation in the field of public-private partnership. Chapter III determines parties to public-private partnership and establishes their rights and duties. Chapter IV regards initiation and preparation of a public-private partnership project. Chapter V regards the procedure of selection of private partner. Chapter VI regards public-private agreements. Chapter VII regards protection of the interests of private partner and creditor. Chapter VIII regards monitoring and accountability in the field of implementation of public-private partnership. Chapter IX establishes the mechanisms of financial support of public-private partnership. Chapter X lays down final provisions.
