Résumé

This Law establishes the rights and obligations of persons who have reported violations in institutions, the bases and forms of their legal protection, as well as measures for the protection, promotion and assistance of such persons in order to provide appropriate opportunities to report violations that threaten or violate the public interest, prevention and detection of irregularities. "Infringement information" means information provided by an internal reporting channel, either directly to the competent authority or directly to the public related to a criminal offense, administrative misconduct, misconduct or breach of duty, as well as a serious breach of mandatory professional ethics or any other threat to the public interest which the notifier becomes aware of from his or her possession of information or through employment relationship or contractual relationship with that body. "Notifier" means a person who provides information on a breach in an establishment with which he has or has had an employment or employment relationship or a contractual relationship (consultancy, contracting, traineeships, internships, volunteering, etc.) and who is recognized as a notifier by the competent authority. Notification means an application to the competent authority in accordance with the formal requirements established by this Law, which provides specific information about the violation that complies with the features established by this Law. According to this law, information on violations is provided due to: (a) danger to public safety or health, life or health of a person; (b) danger to the environment; (c) obstruction or unlawful influence on investigations conducted by law enforcement authorities or in the administration of justice; (d) financing of illegal activities; (e) illegal or non-transparent use of public funds or property; (f) illegally acquired property; (g) concealment of the consequences of the committed violation, obstruction of determining the extent of the consequences; and (h) other violations. A person may provide information about the violation: (a) in the institution through the internal channel for providing information on violations; (b) directly to the competent authority; and (c) in public. The competent authority, having determined that the person who submitted the notification and the information on the violation specified by him or her complies with the requirements established by this Law, shall recognize the person as a notifier and notify him or her thereof. The main measures for the protection, promotion and assistance of whistleblowers are: (a) ensuring secure channels for providing information on infringements; (b) ensuring the confidentiality of a person; (c) a prohibition to have an adverse effect on the person who provided the information on the violation; (d) the right to receive remuneration for valuable information; (e) the right to receive compensation; (f) provision of free legal aid; and (g) disclaimer.
