Résumé

This Law establishes the purpose of the Special Investigation Service of the Republic of Lithuania, the legal bases, tasks and functions of the activity, the organization and financing of the Service, the methods of control over the activities and the rights and duties of officials. The Special Investigation Service of the Republic of Lithuania is a state law enforcement institution accountable to the President of the Republic and the Seimas (Parliament), which prepares and implements corruption prevention measures, detects and investigates crimes involving corruption. The Special Investigation Service follows the Constitution of the Republic of Lithuania, the laws of the Republic of Lithuania, international treaties of the Republic of Lithuania, the Statute of the Office and other legal acts. The Statute of the Special Investigation Service shall be approved by the Seimas (Parliament) of the Republic of Lithuania by law. The Government of the Republic of Lithuania, ministries and other state or municipal institutions and establishments must, at the request of the Special Investigation Service, submit to it within 5 working days legal acts adopted but not published in the Official Gazette. State or municipal institutions and establishments must enable the Special Investigation Service to use the data of state registers, cadastres, classifications and other data banks of state institutions, establishments and enterprises free of charge and without hindrance, and other enterprises, establishments, organizations and natural persons under contracts. The Special Investigation Service protects and defends the individual, society and the state from corruption, and carries out the prevention and detection of corruption. Special Investigation Service shall perform the following functions: (a) carry out operational activities in order to detect and prevent crimes that manifest corruption; (b) conduct a preliminary investigation; (c) cooperate with other law enforcement institutions in accordance with the procedure established by legal acts; (d) collect, store, analyze and summarize information on corruption and related social and economic phenomena; (e) prepare and implement corruption prevention and other measures on the basis of available information; (f) implement crime control and prevention programs with other law enforcement institutions; and (g) at least twice a year provide written information on the results of its activities and submit proposals regarding the improvement of the activities of the Service to the President of the Republic and the Speaker of the Seimas (Parliament).
