Résumé

This Law establishes special provisions applicable to inland water transport of the Republic of Moldova, the procedure for organizing institutional system in this field, special provisions on implementation of safe navigation on inland waterways, as well as fundamental requirements applicable to vessels, crew and persons, operating in the field of water transport. The provisions of this Law apply to: (a) inland waterways of the Republic of Moldova, as well as those located on them navigable hydraulic structures; (b) ports, landing stages, harbours located on inland waterways; and (c) vessels intended for inland navigation and other floating objects, operated on the inland waterways of the Republic of Moldova. Navigation shall be intended activities related to the use of a vessel on inland waterways for the transportation of goods, passengers and their luggage, postal items, towing ships or other floating objects, dredging, construction, track, hydraulic, underwater technical and other similar works, pilotage and icebreaker assistance, rescue operations, protection of waterbodies, protecting them from pollution or clogging, rising sunken property, carrying out sanitary or other types of control, scientific research work, as well as for sports, entertainment and other purposes. Supervision over the safety of port and shipping hydraulic structures is carried out by a competent sectoral body. Inland waterways and navigable hydraulic structures located on them are part of the property of the public sphere of the state and can be used by any individual or legal entity for navigation purposes. The list of inland waterways is approved by the competent central sectoral body. The Republic of Moldova owns two inland waterways of international importance – the Dniester and Prut rivers. Navigation of vessels on inland waterways is authorized only under the State Flag of the Republic of Moldova. Each individual vessel may be authorized to navigate, including for transit purposes, on inland waterways under the flag of a foreign state based on a decision of a competent sectoral body. Ensuring environmental safety during the operation of ships, preventing pollution from ships of inland waterways with wastewater and water containing hydrocarbon residues, oil and other substances harmful to human health and aquatic biological resources are the responsibility of shipowners. Control over ensuring environmental safety during the operation of ships is carried out by the competent sectoral body in the field of environmental protection.
