Résumé This Law establishes the main principles, goals and tasks of corruption prevention in the public service and the private sector, corruption prevention measures and their legal bases, subjects of corruption prevention and their rights and obligations in the field of corruption prevention. Prevention of corruption shall be intended disclosure and elimination of the causes and conditions of corruption by creating and implementing a system of appropriate measures, as well as impact on individuals in order to deter the commission of criminal acts of a corrupt nature. Criminal offenses of a corrupt nature shall be intended bribery, trading in influence, other criminal offenses, when committed in the public administration or in the provision of public services for the benefit of oneself or others: abuse of office or abuse of power, abuse of official authority, forgery of documents or measuring instruments, fraud, embezzlement or waste, disclosure of a trade secret, misrepresentation of income, profits or property, money laundering, interference with the activities of a civil servant or a person performing public functions, or other criminal offenses for the purpose of committing such acts as bribery that are required to be concealed or disguised. Corruption prevention aims to ensure that corruption hinders the development of the economy, democracy, social welfare, strengthening national security, and increasing the quality of public services. The main tasks of corruption prevention are: (a) to disclose the causes and conditions of corruption and eliminate thereof; (b) to deter persons from committing criminal offenses of a corrupt nature; (c) to ensure real and effective legal regulation of corruption prevention; (d) to establish by legal, organizational, economic and social means an appropriate and effective mechanism for the organization, implementation, supervision and control of corruption prevention; (e) involve the population and public organizations in the prevention of corruption; and (f) to promote transparent and open provision of public services. Corruption prevention measures include: (a) corruption risk analysis; (b) anti-corruption programs; (c) assessment of the impact of legal regulation established in legal acts or envisaged in draft legal acts on the extent of corruption (anti-corruption assessment of legal acts or their drafts); (d) submission of information on a person seeking to hold or holding a position in a state or municipal institution or enterprise, or on a person who is provided for a position in the European Union or international institutions by the Republic of Lithuania; (e) submission of information to the registers of civil servants and legal persons; (f) public education and information; (g) public announcement of identified cases of corruption; (h) notification of criminal offenses of a corrupt nature; and (i) other measures for the prevention of corruption established by law. Corruption prevention planning documents are: (a) National Corruption Prevention Agenda; (b) Plan of the National Corruption Prevention Agenda; (c) sectoral corruption prevention programs; (d) institutional corruption prevention programs; and (e) other corruption prevention programs. Anti-corruption public education is carried out as an integral part of public education in order to foster personal morality, develop citizenship, the concept of individual rights and obligations to society, the state of Lithuania and ensure the implementation of corruption prevention goals. Anti-corruption public education is carried out in educational institutions of all types and levels according to the prepared educational programs, through the mass media and in other ways. State and municipal institutions provide the population with information about their activities in the fight against corruption through the media and in other ways. The prevention of corruption established in this Law shall be carried out by: (a) the government; (b) the Chief Commission for Official Ethics; (c) Special Investigation Service; and (d) other state and municipal and non-state institutions.
