Résumé

This Law prescribes geodetic and cartographic activities, its state administration, conditions for the activities of a geodesist, qualification, rights and obligations, distribution of geodetic points, installation and protection, Lithuanian spatial information infrastructure, state spatial data copyright protection and use of maps. Geodetic and cartographic activities shall be performed in the territory of the Republic of Lithuania in the Exclusive Economic Zone and on the continental shelf in the Baltic Sea. Geodetic and cartographic activities include state, thematic and municipal surveying and cartographic works. This Law establishes the procedure for the fulfilment of geodetic and cartographic works, the purpose of the Lithuanian spatial information infrastructure, the state georeferenced spatial data sets, the purpose of the georeference cadastre, the principles of its establishment and management, the ownership rights of geodetic and cartographic production. It is related to geodetic and cartographic works, fundamental rights and duties in geodesy and cartography. This Law establishes the requirements for the use of the Lithuanian Spatial Information Infrastructure, spatial data sets and the Lithuanian Spatial Information Portal in accordance with the legal acts of the European Union specified in the Annex to this Law. Geodetic and cartographic activities include ongoing survey and mapping work performed by state institutions, municipal and specific organizations. Public geodetic and cartographic works include: (a) formation, development, management and adjustment of the state geodetic data and information; (b) adjustment of geoid parameters; (c) aerial photography and remote scanning; (d) establishment, updating and management of state orthophotographic maps and charts; (e) creation, updating and management of georeferenced maps of 1:10 000, 1:50 000, 1: 250 000 scale; (f) compilation, updating and management of all national georeferenced spatial data sets of all scales; (g) cartography of the State border of the Republic of Lithuania; (h) creation, updating and management of state thematic maps; (i) creation, updating and management of state-level topographic maps of all scales; and (j) mapping of the boundaries of residential areas. State orthophotographic and georeferenced map of the entire territory of Lithuania shall be updated at least every 5 years. National georeferenced spatial data sets shall be constantly updated. This Law consists of IX Chapters divided into 28 Articles. Chapter I lays down general provisions. Chapter II specifies geodetic and cartographic activities. Chapter III regards administration of geodetic can cartographic activities. Surveyor is a natural person performing geodesy and cartography work who has a qualification certificate issued by the National Land Service under the Ministry of the Environment, another European Union member state or a competent authority of a European Economic Area state, or another document granting the right to perform these works. State geodesy and cartography works are financed from the state budget of the Republic of Lithuania or the funds of the European Union or other international financial support to the state. The National Land Service under the Ministry of the Environment organizes the geodesy and cartography works included in the state geodetic base management and land mapping programs approved by the Minister of the Environment. When performing geodesy and cartography work in the territory of the Republic of Lithuania, the geodesist must: (a) follow the laws and other legal acts of the Republic of Lithuania in his activities; (b) be impartial; (c) ensure an orderly environment of geodetic points; (d) to provide the National Land Service and the director of the municipal administration with information on the state of geodetic signs in accordance with the procedure established by the Minister of the Environment; and (e) improve the qualifications at least every 3 years according to the programs for improving the qualifications of the surveyor approved by the Director of the National Land Service.
