Résumé This Law appoints the institution exercising state environmental control in the Republic of Lithuania and officials of state environmental control, their legal status, legal bases and main principles of activity, organization of activities, regulates the process of state environmental control. The provisions of this Law have been harmonized with the legal acts of the European Union specified in the Annex to the Law. State control of environmental protection shall be intended activities of the institution exercising state control of environmental protection in the Republic of Lithuania and officials performing state control of environmental protection in relation to economic entities and other natural and legal persons aimed at ensuring legality and law and order in the field of environmental protection and use of natural resources; prevention of violations of laws and other legal acts regulating the use of natural resources, termination of violations and identification of persons who have committed such violations, and bringing them to legal liability. This Law establishes the public control over the state of the environment by institutions and officials, defines legal status thereof, the legal basis of activity and the basic principles, organization of activities, and regulates the process of state environmental control. It determines environmentally harmful activities as those, exceeding established environmental standards and rates, which cause negative environmental impact, performed by natural and legal persons. Authorized public officials shall be granted the right to suspend environmentally harmful activities, i.e. prohibit to a natural or legal person to pursue a specific environmentally harmful activity for a certain period of time. Mass destruction of wild fauna and wild flora species shall be classified as environmentally harmful activity, which constitutes an offence. State control over environmental protection performed by state environmental control authorities shall consist in: (a) enforcement of compliance with legislative requirements related to environmental protection; (b) supervision over authorized legally regulated management of land, subsoil, surface and underground waters, atmospheric air, vegetation (including forests), wildlife (including fish stocks) and other natural resources; (c) obligation of restoration of natural resources in a timely and appropriate manner by natural and legal persons; (d) application of polluter pays principle and compliance thereof with emission standards; and (e) supervision over implementation of environmental protection programs and measures. This Law consists of VII Chapters divided into 54 articles. Chapter I lays down general provisions. Chapter II regards organization, enforcement and application of state environmental protection. Chapter III establishes the powers of state environmental control officials. Chapter IV establishes the procedure of state environmental protection. Chapter V establishes law enforcement practices by public officers. Chapter VI establishes the rights and duties of volunteer environmental inspectors. Chapter VII lays down final provisions.
