The Inland Waterways Transport Code regulates the relations between inland waterways, port activities, cargo, towage, as well as liability for damage caused by inland waterway transport and other violations of the provisions of this Code. Inland waterway transport is an integral part of the economic and social development of the Republic of Lithuania and is part of the infrastructure for inland waterways transport of people and cargo. Inland waterway transport infrastructure means a part of the transport infrastructure consisting of inland waterways, dams navigable water gates. Inland waterways of national significance shall be exclusive property of the state. Local inland waterway transport infrastructure shall be exclusive property of local government (municipalities). The state management of inland waterway transport in the Republic of Lithuania in accordance with their competence shall be performed by the Government, the Ministry of Transport and Communications and the Lithuanian Transport Safety Administration. The Transport Safety Administration shall establish technical and organizational requirements governing safe navigation, control the implementation of legal acts regulating inland waterway transport activities and perform other functions specified in this Code and other legal acts. Inland waterways transport activities shall be subject to mandatory licensing by the Transport Safety Administration. Inland waterways - navigable rivers, lakes, artificial water bodies and the part of the Curonian Lagoon belonging to the Republic of Lithuania, which contain navigation signs or the fairway of which is marked on the pilot's maps. Inland waterways are classified as national and local routes. Inland waterway users are natural and legal persons, other organizations or their branches engaged in shipping on these water routes. Inland waterway users shall also include natural and legal persons, other organizations or their branches which, in agreement with the inland waterway operators, use inland waterways for hydraulic, fishing, sporting, recreational and other purposes without prejudice to the rules of navigation. Natural and legal persons, other organizations or their subdivisions to which hydroelectric power plants, dams and other hydraulic structures on inland waterways belong must: (a) above and below the facilities to maintain the water level necessary for safe navigation throughout the navigation period; (b) to create conditions for the unimpeded and safe passage of inland waterway vessels through hydraulic structures; (c) release water from water reservoirs at a time determined by the inland waterway management authorities; and (d) supervise the technical condition of hydraulic engineering structures. "Inland port" means the water area of an inland port and its territory, with berths three times the length of the largest vessel allowed to enter or leave, cargo storage facilities, structures, installations and infrastructure for access to the inland port, standing, repairing and disembarking, loading, embarking or disembarking passengers. In the territory of the Republic of Lithuania, it is prohibited to use inland ports or commercial wharves that are not registered and included in the List of registered inland ports or in the List of registered wharves. The master of an inland port shall perform control in the waters of inland ports and ensure safety in the inland port. Inland waterway vessels shall be intended inland waterway, fishing, small, recreational, sport, traditional and personal watercraft, floating equipment (self-propelled and non-self-propelled) which is operated in navigation areas of inland waterways. The Register of Inland Waterway Vessels of the Republic of Lithuania is a state register. Inland waterway operators must mark the route for navigation (signposting and warning) signs.
