The Law enters into force from the date of its official publication.
Résumé

The Law consists of 12 Sections composed of 38 articles dealing with the following matters: 1) general provisions (sect.1, arts. 1-4); 2) modalities of setting up peasant farm (sect. 2, arts. 5-8); 3) state support of peasant farms (sect. 3, arts. 9-11); 4) land of peasant farms (sect. 4, arts. 12-18); 5) property of peasant farm (sect. 5, arts. 19-21); 6) alienation of property of peasant farm (sect. 6, arts. 22-23); 7) functioning of peasant farm (sect. 7, arts. 24-32); 8) representative body of peasant farm (sect. 8, art. 33); 9) welfare and social security (sect. 9, art. 34); 10) termination of activity of peasant farm (sect. 10, arts. 35-36); 11) liability (sect. 11, art. 37); 12) conclusive provisions (sect. 12, art. 38). Farming is a form of entrepreneurial activity of citizens who have expressed a desire to produce marketable agricultural products, carry out its processing and trade in order to make a profit on land provided to them for ownership and/or tenancy, including rent, for farming, commodity agricultural production, personal farming, in accordance with the acting legislation. Peasant farms can be set up by a single Ukrainian national or by household (art. 1). The farm is subject to state registration as a legal entity or a natural person - entrepreneur. The farm operates on the basis of the constituent document (for a legal entity - the statute, for the economy without the status of a legal entity - the agreement (declaration) on the establishment of the farm). The constituent document indicates the name of the farm, its location, address, subject and purpose of activity, the procedure for forming property (capital), management bodies, the procedure for making decisions, the procedure for entering and leaving the farm and other provisions that do not contradict the legislation of Ukraine. Any capable Ukrainian national from the age of 18 years that has given assent and has passed professional selection has the right to set peasant farm (art. 5). Plots of land for farming shall be allotted to the Ukrainian nationals in ownership or in lease out of the stock of public or municipal land. Plots of land amounting to a land share of the agricultural enterprises located on the territory of a given municipal unit shall be allotted in ownership free-or-charge to the members of peasant farm (art. 7). After issuing the state certificate of the right of ownership or lease to a plot of land and the state registration thereof the peasant farm must pass the state registration (art. 8). Lands of peasant farm shall be composed of: 1) plot of land owned by peasant farm as legal entity; 2) plots of land owned by the members of peasant farm as private ownership; 3) plot of land conceded in lease to peasant farm (art. 12). Members of peasant farm shall have the right to: 1) sell or transfer plot of land, concede it in lease, mortgage or devolve it; 2) to conduct autonomously activity on land; 3) exercise property right to plantations and crops and the output of agricultural commodities; 4) compensation of losses; 5) trade of agricultural commodities on internal and external markets (art. 14).
