Résumé

This Law regulates specific rules regarding the sale of land. Albanian private natural and legal persons have the right to freely buy and sell land among themselves without any restrictions. Land is all the land that is located within the boundary lines of cities (municipalities), regardless of whether it is used for construction, gardens, fields, etc., as well as the land outside the boundary lines that at the time of treatment has been used or will be used for construction, provided that the documentation proving its alienation has been completed, as it is no longer agricultural land, meadow or pasture, etc. A plot of land is called occupied when legal investments have been made in it (foundations, excavations, installations, sewers, buildings, etc.) that exceed the price of that plot of land. The occupied plot covers an area that is necessary for the normal operation the object to be built, as well as on surfaces which, based on the urban planning rules, cannot be used by another person (such as surfaces in front of the windows of existing buildings, between buildings, etc.). Until the physical compensation of the former owners is completed, the transfer of vacant land from state property to private property is allowed only in the following cases: a- For the construction of housing in order to free the housing of the former owners, as well as to the homeless, built by the Housing Authority or other persons. b- By decision of the Council of Ministers, for sale, for very important investments for the country.
