Résumé The Law consists of 17 Sections and 90 articles dealing with the following matters: general provisions (sect. 1, arts. 1-9); rights of citizens and associations in the sphere of the utilization of nuclear energy and radiation safety (sect. 2, arts. 10-16); jurisdiction of the executive and managing bodies (sect. 3, arts. 17-21); state regulation of the safe utilization of nuclear energy (sect. 4, arts. 22-30); legal status of legal and natural persons carrying activity in the sphere of the utilization of nuclear energy and radiation safety (sect. 5, arts. 31-36); distribution, construction, putting in and out of operation of nuclear plants and sites for radioactive waste management (sect. 6, arts. 37-44); special regime of the location of nuclear plants and radioactive waste management sites (sect. 7, arts. 45-47); special conditions of regulation of the safety of vessels, space vehicles and aircraft with nuclear reactor or source of ionizing radiation (sect. 8, arts. 48-49); radioactive waste management (sect. 9, arts. 50-53); transport of nuclear materials (sect. 10, arts. 54-59); physical protection of nuclear plants, radioactive materials, radioactive waste and other sources of ionizing radiation (sect. 11, arts. 60-66); prevention of the utilization of nuclear materials, equipment and technologies for military purposes (sect. 12, arts. 67-71); compensation of radioactive damage (sect. 13, arts. 72-80); liability for the infringement of the legislation (sect. 14, arts. 81-83); export and import of nuclear plants, technologies and materials (sect. 15, arts. 84-86); international cooperation (sect. 16, arts. 87-88); final provisions (sect. 17, arts. 89-90). The present Law is the basic in the legislation on nuclear energy, it establishes the priority of the protection of the population and environment and regulates activity connected with the utilization of nuclear plants and the sources of ionizing radiation. The main tasks of the legislation on nuclear energy shall be: 1) legal regulation of all types of the utilization of nuclear energy; 2) establishment of the basic principles of the protection of the population and environment (art. 3). The main principles of the state policy shall be: 1) priority of the protection of the population and environment against impact of the ionizing radiation; 2) to ensure such utilization of nuclear energy which produces the minimum amount of radioactive waste; 3) burial and long-term storage of radioactive waste at the expense of the producers thereof (art. 5). The Law is applicable to all types of activity connected with the utilization of nuclear energy, including: 1) putting in and out of operation nuclear plants and the sources of ionizing radiation; 2) management of the nuclear materials and the sources of ionizing radiation; 3) research; 4) registration (art. 7). The state regulation in the sphere of safe management of nuclear energy envisages: 1) setting criteria and requirements (regulation) for the management of nuclear plants and sources of ionizing radiation; 2) authorization for the aforesaid activities; 3) supervision (art. 22). Construction, reconstruction, putting out of operation, amendment of requirements and safety regulations of nuclear plants and sites for the management of radioactive waste shall be subject to compulsory environmental audit (art. 40). Organization, carrying out the registration and supervision of the nuclear materials shall be the competence of the authorized state institution in the sphere of nuclear and radiation safety (art. 68).
