Résumé

This Law determines the types of activities subject to licensing, establishes the legal basis for the issuance of licenses for the right to engage in certain activities and aims to ensure compliance with standards and qualification requirements to ensure protection of interests and safety of individual, society and state. Licensing shall be intended activities related to the issuance of licenses, reissuance of documents confirming the availability of licenses, suspension and renewal of licenses, revocation of licenses and control by licensing authorities for compliance by licensees in the implementation of licensed activities related to licensing requirements, terms and conditions. The basic principles of licensing shall be as follows: (a) ensuring the unity of economic space on the territory of the Republic of Tajikistan; (b) establishment of a unified list of licensed types of activities; (c) establishment of a unified licensing procedure on the territory of the Republic of Tajikistan; (d) establishment of licensing requirements and conditions by the regulation on the particulars of licensing of certain types of activities; (e) publicity and openness of licensing; and (f) observance of legality in the implementation of licensing. The type of activity for which the license is granted may be performed only by a legal entity or individual entrepreneur, holders of the license. The license applies to the entire territory of the Republic of Tajikistan. In cases directly envisaged by the legislation of the Republic of Tajikistan, the license may only be applied to a certain area of the territory of the Republic of Tajikistan. This Law establishes the procedure for issuance of licenses and validates the list of documentation to be submitted to the licensing authority for issuance of license. The following activities shall be subject to mandatory licensing: (a) operation of explosive, fire hazardous, chemically hazardous production facilities; (b) extraction, production, development of oil, gas, coal and exploitation oil and gas network facilities; (c) storage and sale of oil, gas and products of their processing (except in cases where the specified activity is carried out to ensure own needs of a legal entity or individual entrepreneur); (d) industrial safety expertise; (e) manufacturing, storage, distribution, transportation and the use of industrial explosives; (f) generation, transmission and distribution of electrical energy (except in cases where the specified activity is carried out for own needs of a legal entity or an individual entrepreneur); (g) all operations related to nuclear energy; (h) geodetic and cartographic activity; (i) hydrometeorological activities; (j) activities related to import and export, production, sale, use, transportation, storage, processing and disposal of radioactive substances; and (k) activities for the acquisition, sale, use, disposal and destruction of substances that deplete the ozone layer.
