Résumé This Law establishes legal grounds for production, reproduction, processing, certification, trade of seeds, planting materials and plants, and also registration of seed varieties and carrying out seed control. The Act consists of 8 Sections divided into 35 articles: (1) general provisions; (2) classification of types of seeds; (3) organization of seed-growing; (4) seed production of processing; (5) variety and seed control; (6) marketing of lots of seeds; (7) organizations authorized to carry out registration of varieties and seed control; and (8) conclusive provisions. The authorized institution in the sphere of agriculture and forestry shall establishes production methods of seed varieties. State support in the sphere of seed-growing shall be carried out by: (a) incentives; (b) subsidies; (c) preferential credits; and (d) other measures of economic stimulation. The use of contaminated and infected seeds and containing pests for the purpose of seed-growing shall be prohibited. State seed fund shall be used as reserve of seeds destined for areas with lacking or limited seed-production. Each lot of seeds destined for trade shall be subject to mandatory certification. Seed certification shall be intended a seed quality assurance system that includes field inspection, variety control in special areas and laboratory analysis of seeds varieties included in the State Register of Plant Varieties. State Register of Plant Varieties is a list in which are recorded varieties and hybrids of plants that have passed the official test. Methods for the production of seeds of the respective categories shall be established by the authorized state body for managing agriculture and forestry. The breeder of a variety is the natural or legal person who created the plant variety ensuring conservation of the variety and its data recorded in in the State Register of Plant Varieties. Depending on hereditary properties, the following categories of seeds are defined as pertaining to forest plants: normal, improved and varietal. Appurtenance pf seeds of forest plants to the specified categories of seeds of forest plants is determined by the authorized state control body in the field of Agriculture. Authorized government body in the field of agriculture compiles and maintains a list of producers, importers and exporters of seeds in a systematic manner. The State Seed Fund is formed by the authorized state governing body in the field of agriculture and financed by the national budget and other sources, envisaged by acting legislation, in the manner prescribed by the Government of the Republic Tajikistan, and is the national property. The state body for the control and certification of seeds may issue certificates of varietal purity based on the results of laboratory tests for original, elite and reproduction seeds. It is prohibited to import into the Republic of Tajikistan unpackaged consignments of seeds (in bulk), as well as batches of seeds whose varieties are not included in the State Register of Plant Varieties, with the exception of seed lots intended for scientific research, state tests, production of seeds for export from the Republic of Tajikistan.
