This Law enters into force on the date of its official publication.
Résumé

In accordance with the Constitution and universally recognized norms of international law, this Law establishes the procedure for the entry into, stay in and departure from the country of Turkmen citizens, foreign nationals and stateless persons, and defines the legal relations in the area of migration in Turkmenistan and the competence of Government bodies to regulate migration processes in Turkmenistan. Labour migration shall be intended lawful voluntary movement of natural persons permanently residing in Turkmenistan, outside Turkmenistan, as well as foreign citizens and stateless persons, permanently residing in foreign countries and coming to Turkmenistan for the purpose of employment. Illegal migration shall be intended entry into and stay in Turkmenistan in violation of Turkmenistan legislation. Administrative expulsion shall be intended forced and controlled movement of foreign nationals, stateless persons through the State border of Turkmenistan beyond its borders in cases, envisaged by Turkmenistan legislation. Regulation of migration processes in Turkmenistan is based on the following principles: (a) ensuring human rights enshrined in the Constitution to free choice of place of residence, type of activity and profession and freedom of movement; (b) prohibition to infringe individual rights and freedoms on grounds of ethnic background, race, sex, origin, wealth, official status, place of residence, language, attitude to religion, political convictions, party affiliation or lack thereof, or for other reasons; (c) ensuring compliance of Turkmenistan legislation with universally recognized norms of international law and international agreements on migration; (d) detection, prevention and suppression of illegal migration in Turkmenistan; (e) respect for and compliance with Turkmenistan legislation by migrants; (f) cooperation between Government bodies and public associations in regulating internal migration processes; and (g) participation of Government bodies in regulating external migration processes. This Law consists of VIII Chapters divided into 51 Articles. Chapter I lays down general provisions. Chapter II regulates entry into, stay in, and exit from Turkmenistan of foreign citizens and stateless persons. Chapter III regards Turkmenistan residence permits. Chapter IV regards migration control in Turkmenistan. Chapter V regulates exit from ad entry into Turkmenistan of Turkmen citizens. Chapter VI regards internal migration. Chapter VII establishes liability for the violation of Turkmenistan legislation on migration. Chapter VIII lays down final provisions.
