Résumé This Law defines the main directions of the state policy in the field of ensuring the food security of Turkmenistan, which is an integral part of the state’s economic security, and also establishes the legal basis for the realization by citizens of the right to healthy and complete nutrition. Food security shall be intended the state of the national economy, which ensures the food independence of the country, the necessary level of production of vital food and alimentary raw materials, as well as ensures the physical and economic availability of food for the entire population in the quantity necessary for an active and healthy life. Provision of food security shall be intended the development and implementation of economic, institutional and other measures aimed at the prevention of food crises, meeting the needs of the population in essential food products in accordance with rational nutrition standards. Food security of Turkmenistan is ensured by the Cabinet of Ministers of Turkmenistan, authorized state bodies in the field of food security and local executive authorities. The basis of the calculation system related to the assessment of the level of food security of Turkmenistan is the balance between the necessary and the actual level of food production, annually approved by the Cabinet of Ministers of Turkmenistan. In the event of a food crisis or its threat, state administration authorities in the field of food security of Turkmenistan may establish special food safety regimes for a limited time, including determining measures for the distribution of food through rationing. The strategic goal of food security of Turkmenistan shall be to provide the population with safe agricultural, fish products and other foodstuffs, as well as to increase the consumption by the population of Turkmenistan of vital food products to the level of rational norms of their consumption. The guarantee of its achievement is the stability of domestic production, as well as the availability of the necessary reserves and food stocks. The main tasks of ensuring food security of Turkmenistan, regardless of changes in external and internal conditions, shall be as follows: (a) timely forecasting, identifying and preventing internal and external threats to food security, minimizing their negative consequences due to the constant readiness of the food supply to the population and formation of food reserve stocks; (b) sustainable development of domestic production of agricultural, fishery products and foodstuffs sufficient to ensure food sovereignty; (c) achievement and maintenance of physical and economic accessibility for every citizen of the state of safe food products in the amount and range that meet the established rational norms of food consumption required for an active and healthy lifestyle; and (d) creation of conditions for supply, manufacturing and circulation of safe and high-quality foodstuffs products in the territory of Turkmenistan. To ensure food security of Turkmenistan, the following basic measures shall be implemented: (a) development and implementation of legal, economic, organizational, technical and other measures aimed at the production of vital foodstuffs and alimentary raw materials; (b) ensuring uninterrupted supply of food to the places of their consumption in a volume sufficient to meet the needs of the population; (c) ensuring the possibility of purchasing food by the population, including on preferential terms, with the existing structure of consumption, price system and income level; (d) creation, renewal and replenishment of the state food reserve, consisting of a minimum operating stock of agricultural commodities, fishery products and foodstuffs; (e) ensuring state control over the compliance of food security and the quality of vital foodstuffs and alimentary raw materials produced and sold to citizens with the requirements of the regulatory legal acts of Turkmenistan in the field of food security and regulatory documents on standardization and certification; and (f) creation of conditions for the dynamic development of the agro-industrial and fisheries complex. This Law consists of 4 Chapters divided into 19 Articles. Chapter 1 lays down general provisions. Chapter 2 regards state management in the field of food security. Chapter 3 regards dispute settlement and establishes liability for the infringement of the legislation on food security. Chapter 4 lays down final provisions.
