The Law enters into force from the date of its official publication.
Résumé

The present Law regulates the relations in the sphere of protection and rational management of wildlife and is directed at the conservation of genetic stock and biological diversity, protection of natural habitats thereof on land, water, in the atmosphere and in the soil. Wildlife in Turkmenistan pertains to the exclusive property of the state (art. 2). In the process of carrying out the arrangements that may have impact upon the natural habitats and the state of wildlife the following requirements shall be met : 1) conservation of the integrity of the natural communities of wildlife species ; 2) conservation of biological diversity in the state of natural freedom ; 3) protection of the natural habitats and the migration routes ; scientific research, rational management and reproduction of wildlife species ; 4) regulation of numbers of wildlife species for the purpose of the protection of public health and prevention of the contraction of disease by agricultural animals (art. 3). Enterprises, institutions and organizations irrespectively of the form of property, foreign legal persons, nationals of Turkmenistan and other persons residing or staying on the territory of Turkmenistan can be managers of wildlife (art. 10). The following types of wildlife management can be authorized on condition of meeting the requirements set by the legislation of Turkmenistan: 1) hunting; 2) fisheries, including catch of aquatic invertebrates and marine mammals; 3) hunting of animals not included in the list of hunting and fishing species; 4) management of wildlife for economic, scientific, educational and recreational purposes; 5) management of wildlife species for the purpose of obtaining wildlife products. The national legislation can envisage also other types of wildlife management. Wildlife management without the removal of wildlife species from their natural habitats is free of charge while wildlife management with the removal of wildlife species from their natural habitats or causing damage thereto is charged and shall be carried out in conformity with hunting licence (art. 11). Catch of all types of snakes on the national territory can be carried out in conformity with permits issued by the Ministry of Environmental Protection (art. 17). The Red Book shall be kept for the purpose of recording and registration of rare and endangered species and ensuring the necessary arrangements for the conservation and rational management thereof (art. 29). The Law consists of 9 Sections composed of 46 articles.
