Résumé This Law defines the organizational and legal basis for the implementation of equal rights and opportunities for all persons in the Republic of Tajikistan and establishes a legal system for prevention and effective protection against all forms of discrimination. Discrimination is any distinction, exclusion, restriction or preference formed on real and (or) perceived grounds in relation to any natural or legal person or group of persons, their relatives or persons otherwise related to them and based on race, skin color, origin, gender, language, religion and belief, national or ethnic origin, disability, state of health, age, citizenship, opinion, property status or other circumstance and the purpose or effect of which is to degrade, destroy and (or) diminish recognition, use or exercise by all persons, on an equal basis, all human rights and freedoms. This Law applies to all government agencies, self-government bodies of towns and villages, officials, individuals and legal entities, regardless of their organizational and legal form and scope of activity. In the Republic of Tajikistan, everyone is equal before the law and the court and has the right to effective protection from all forms of discrimination. Any person or group of persons who believe that they have been discriminated has the right to apply to judicial and other government authorities for protection of their rights, as well as the right to fair and adequate compensation or satisfaction for any damage suffered as a result of discrimination. The State guarantees equal and effective legal protection against discrimination and takes measures to promote policies and programs aimed at ensuring equality and eliminating all forms of discrimination. Discrimination is expressed in direct and indirect forms. Incitement to discrimination is any conduct by which a person exerts pressure or exhibits certain behavior with the aim of discriminating against a third person on the grounds established by this Law. This Law contains 5 Chapters divided into 23 Articles. Chapter 1 lays down general provisions. Chapter 2 establishes competence and powers of state bodies and self-government bodies on issues of ensuring equality and elimination of all forms of discrimination. Chapter 3 establishes the rights of natural persons and legal entities on issues of equality and the elimination of all forms of discrimination.
