Résumé

This Law regulates public relations in the field of tourism and defines the organizational, legal, economic, social, cultural foundations for the development and formation of this sphere. Hunting and fishing shall be intended a type of tourism organized by tourism service providers in the manner established by the legislation of the Republic of Tajikistan, with the involvement (participation) of citizens of the Republic of Tajikistan, foreign citizens and stateless persons. Ecotourism is a type of tourism carried out in the natural environment, the purpose of which is to observe the natural landscape, maintain environmental protection and respect the integrity of ecosystems. The state supports the organization and development of the tourism sector, ensures equal and competitive conditions for the activities of tourism service providers, guarantees the protection of the rights and freedoms of tourism service providers and their access to tourism resources. The principles of activity in the field of tourism are: (a) providing favorable conditions for the development of tourism; recognition of tourism as one of the priority areas of economic development of the country; (b) guaranteeing free economic, social and cultural activities of tourism service providers; support and encouragement of initiatives in the field of tourism; (c) presenting the Republic of Tajikistan as a travel-friendly country and transforming it into a competitive tourist country; (d) protection of the rights and freedoms of subjects of activity in the field of tourism; (e) ensuring the development of educational tourism; and (f) ensuring mass use of tourism resources. Tourism activities shall be subject to mandatory licensing. Tourist services are subject to monitoring and evaluation by the authorized state body in the field of tourism in the manner established by the legislation of the Republic of Tajikistan. To attract citizens of the Republic of Tajikistan, foreign citizens, stateless persons to travel, a contract is concluded between the subject of tourism services and the tourist. A standard tourism contract is determined by the authorized body in the tourism sector. This Law contains 7 Chapters divided into 38 Articles. Chapter 1 lays down general provisions. Chapter 2 classifies forms and types of tourism. Chapter 3 establishes competence and powers of state bodies in the field of tourism. Chapter 4 regards state regulation in the field of tourism. Chapter 5 defines subjects of tourism services. Chapter 6 regards stimulation of tourism. Chapter 7 lays down final provisions.
