Résumé The Law ratifies the European Patent Convention which was signed in Munich on 5 October 1973. Among other provisions, article 53 of the Convention, regarding the patentability of inventions, establishes that European patents shall not be granted in respect of plant or animal varieties or essentially biological processes for the production of plants or animals. This provision shall not apply to microbiological processes or the products thereof. It should be stressed out that this article does not dispute that an animal or plant can constitute a product of invention. It simply excludes such an invention from patent-related consolidation.
