This Law enters into force on the date of its official publication.
Résumé

This Law sets out the regulatory framework for the conduct of business in the sector of electricity and thermal energy produced in cogeneration, in order to make optimal use of primary energy resources and achieve the objectives of energy security, competitiveness and sustainable development in terms of accessibility, availability and affordability of prices and in compliance with safety, quality and environmental protection. Energy storage shall be intended the process of transforming electricity into a form of energy that can be stored in order to postpone its use for a time after the generation and subsequent conversion of that energy into electricity or its use in another energy sector. The national energy strategy shall define the medium and long-term objectives of the electricity sector and the most efficient ways of achieving them, with a view to ensure sustainable development of the national economy and the satisfaction of energy needs and a civilized standard of living, in terms of quality, both now and in the medium and long term, at an affordable price. The energy strategy is developed by the relevant ministry in consultation with representatives of the energy industry, non-governmental organizations, social partners and representatives of the business environment, is promoted by a draft law by the Government and approved by Parliament. Energy strategy is revised periodically at the initiative of the ministry, without prejudice to the specific stability and predictability of such a document, which after revision will be approved in accordance with the procedure established by acting legislation. Energy policy must envisage: (a) establishment of the appropriate institutional framework, by defining the bodies and authorities competent to implement energy policy; (b) ensuring the legal framework necessary for the safe and stable functioning of Southern Energy Network (SEN); (c) ensuring security of fuel and electricity supply and safety in the operation of Southern Energy Network (SEN); (d) ensuring the protection of the environment, the ecological reconstruction of sites affected by energy activities; (e) transparency of fuel and energy prices and tariffs; (f) increasing energy efficiency; (g) promoting energy from renewable sources, from unconventional sources, high efficiency cogeneration and energy storage, with priority given to electricity supply for isolated settlements; and (h) development of international energy cooperation, participation in regional markets and European electricity market, in order to achieve unified energy market at the level of the European Union and ensure safe and secure of Southern Energy Network (SEN). The commercial exploitation of energy production capacity may be carried out without a license granted by National Energy Regulatory Authority (ANRE) in accordance with the provisions of this Law, by: (a) holder of electricity generation capacities that can be switched on without voltage from Southern Energy Network (SEN), self-starting units and which are used thereby for the purpose of safely supplying electricity to his own equipment or installations; and (b) holder of capacities for the production of electricity, including electricity and heat produced in cogeneration power plants, connected to the electricity grid, with a total electricity capacity of less than 1 MW.
