This Law enters into force on the date of its official publication.
Résumé

This Law regulates relations originating in the field of legal protection and use of appellation of origin of commodities. State register of appellation of origin shall be intended the document containing information and data and the right of use thereof, information of particular properties of commodities with registered appellation of origin, and also other information and data related to state registration of appellation of origin. Official journal of appellation of origin shall be intended periodical edition of the authorized institution in the field of legal protection of appellation of origin destined for publication of information on applications accepted for examination, state registration of appellation of origin and right of use thereof, inserted in State register. Right of use of appellation of origin shall be protected by this Law or in accordance with international agreements of which Turkmenistan is a Party, and shall be attested by certificate. Right of use of one and the same appellation of origin can be granted to any person, who produces within the same geographic area commodities with the same basic properties. Nobody shall have the right to use appellation of origin registered in Turkmenistan without state registration of the right of use of the aforesaid appellation of origin. Foreign natural and legal persons shall be granted the rights, envisaged by this Law, pari passu with natural and legal persons of Turkmenistan in accordance with international agreements of which Turkmenistan is a Party. Right of state registration of appellation of origin in Turkmenistan shall be granted to natural and legal persons of foreign state granting analogous right to natural and legal persons of Turkmenistan. Foreign natural and legal persons shall implement their rights in relations with authorized institution in the field of appellation of origin through patent agents. Application for registration of appellation of origin, signed by applicant and patent agent, shall be submitted to the authorized institution Turkmenpatent and must contain the following documentation: (a) application for state registration and right of use of appellation of origin or right of use of previously registered appellation of origin written in state language and indicating place of residence or location of applicant; (b) requested appellation of origin; (c) indication of commodities subject to application of appellation of origin; (d) description of particular qualities of commodities; and (e) indication of appellation of origin (geographic area), natural conditions and (or) ethnographic factors, which exceptionally or mainly determine or can determine particular properties of commodities. Certificate of the right of use of appellation of origin shall be valid for 10 years from the date of submittal of the application to Turkmenpatent. The period of validity can be extended for the next 10 years. This Law contains IV Chapters divided into 29 Articles. Chapter I lays down general provisions. Chapter II regards state regulation and control in the field of legal protection and use of appellation of origin of commodities. Chapter III regards state registration of appellation of origin of commodities and the right of use of the aforesaid appellation of origin. Chapter IV lays down final provisions.
