The Law enters into force from the date of its official publication.
Résumé

The Law consists of 5 Sections and 17 articles dealing with the following matters: general provisions (sect. 1, arts. 1- 5); licensing in the sphere of the utilization of nuclear energy (sect. 2, arts. 6-11); the modalities of licensing of the exploiting organizations at all stages of the life cycle of nuclear plants and storage points for the burial of radioactive waste (sect. 3, arts. 12-16); the rights and the duties of the subjects of activity in the sphere of the utilization of nuclear energy; final provisions (sect. 5). The system of licensing in the sphere of the utilization of nuclear energy is aimed at the prevention of radioactive pollution. The main targets of the Law shall be: 1) legal regulation of the licensing activity in the sphere of the utilization of nuclear energy; 2) establishment of the legal regime in the sphere of the utilization of nuclear energy (art. 2). The purpose of licensing shall be: 1) to ensure the utilization of nuclear plants, sources of ionizing radiation and sites for radioactive waste management complying with the international requirements; 2) to ensure the execution of activity in the sphere of the utilization of nuclear energy by natural and legal persons that can guarantee the compliance with the legislative requirements and norms, regulations and standards of nuclear and radiation safety (art. 4). The priority of the licensing shall be given to the safeguard of nuclear and radiation safety in the process of decision-making regarding issue or refusal to issue licence. Licensing procedure envisages: 1) licensing of exploiting organization at a single stage of the life cycle of a nuclear plant and storage point for the burial of radioactive waste; 2) authorization to run reactor facility of a nuclear plant; 3) certification of the sources of ionizing radiation; 4) the state registration of the sources of ionizing radiation (art. 6). Some activities subject to compulsory licensing shall include: 1) projecting of nuclear plant or storage point for the burial of radioactive waste; 2) processing of uranic ore; 3) processing, storage and burial of radioactive waste; 4) manufacturing, conservation and maintenance of the sources of ionizing radiation; 5) utilization of the sources of ionizing radiation (art. 7).
