Résumé This Law creates the Statute of Racial Equality, intended to guarantee the black population the realization of equal opportunities, the defense of individual, collective and diffuse ethnic rights and the fight against discrimination, including gender and race inequality, which accentuates the social distance between black women and other social segments of the society. The participation of the black population, under conditions of equal opportunity, in the country's economic, social, political and cultural life will be promoted, as a priority, through: inclusion in public policies for economic and social development; adoption of affirmative action measures, programmes and policies; modification of the institutional structures of the State for adequate confrontation and overcoming of ethnic inequalities resulting from prejudice and ethnic discrimination; promotion of regulatory adjustments to improve the fight against ethnic discrimination and inequalities in all manifestations; elimination of historical, sociocultural and institutional obstacles that impede the representation of ethnic diversity in the public and private spheres; encouragement, support and strengthening of civil society initiatives aimed at promoting equal opportunities and combating ethnic inequalities, including through the implementation of incentives and criteria for conditioning and prioritizing access to public resources; implementation of affirmative action programmes aimed at confronting ethnic inequalities with regard to education, culture, sports and leisure, health, safety, work, housing, mass media, public funding, access to land, justice, and others. Affirmative action programmes will consist of public policies aimed at repairing social distortions and inequalities and other discriminatory practices adopted, in the public and private spheres, during the process of social formation in the country.
