Thus, the Governor has the sole prerogative to designate parts of the State as urban areas. The effect of this designation is that this designated areas lie under the control and management of the Governor, the undesignated lands in the rural areas continue to be controlled by the respective Local Government Areas. The main powers of the Governor under this Law include (a.) to grant a certificate of occupancy for any term not exceeding ninety-nine years (since the Land Use Act of 1978 ultimately harmonized the tenure system in Nigeria to that of a leasehold), (b.) to grant right of occupancy to a citizen of Nigeria for a period of ninety-nine years, and (c) to grant licences for the temporary use of land. By this, the Governor’s assent is a legal necessity for the perfection of any transfer of title in land. Similarly, the law provides that the Local Government has the power to grant customary rights of occupancy to any person for the use of land in the Local Government Area for residential, agricultural and other purposes, and to grant customary rights of occupancy to any person for the use of land for grazing purposes and other purposes ancillary to agricultural purposes as may be customary in the Local Government Area concerned. The Law provides in the detail the manner in which this grants are made. The Law further vests in the Governor the power to make regulations under the Law. Texte intégral Anglais
