Résumé

This Law is divided into 4 parts. The 1st part makes a general introduction of the Law. The 2nd part provides for the Forestry Unit within the state Civil Service. This consists of the Forestry Department, headed by a Director and other Officers to oversee forestry matters in the state. The Director is charged with supervising and regulating the conservation and management of forests, preparing forest inventories and demarcating and maintaining forest reserve boundaries, controlling the cutting, harvesting, milling and sale of timber, among others. The 3rd part provides for forest reserves and lists places in the first schedule of the Law that are designated as forest reserves. The Governor of the state is given the power to declare new places as forest reserves and the procedure for such designation is specified in subsequent provisions. The 2nd schedule of the Law contains a list of trees or plants designated as protected species. The 4th part provides for forestry activities. Certain acts are prohibited in forest reserves including; to take any forest produce; to uproot, burn, de-bark or remove leaves from a tree therein; to reside or erect structures or camps in a reserve; to set fire without due precaution to prevent its spreading; to set fire in any part of a forest reserve, protected forest, conservation area or communal forest; to graze animals or allow animals to trespass forest reserves, among others. The 5th part provides for offences and sanctions for prohibited acts. The final part provides for a wide range of issues related to forestry including issues relating forest fires, bush burning, forest produce, legal proceedings, among others. The Director is charged with setting up a forest fire control unit to carry out acts necessary for the purpose of preventing, controlling and averting forest fires. The Law prescribes punishments for bush burning and setting wild fires in forest reserves and ends with the manner in which forest officers may institute legal proceedings.
