These Instructions enter into force on the date of their publication in the Official Gazette.
Résumé

These Instructions consisting of 14 articles apply (i) to the packaging materials used for packaging products and finished goods that are sold and consumed in the local market and have negative effects on the environment through the accumulation of their waste; (ii) by producers, importers, and providers of finished goods and materials that result in waste packaging materials, including products packed in service packaging materials, that are sold to the consumer directly, whether in restaurants or shops that provide and sell foodstuffs; (iii) the requirements contained in these instructions are valid at any stage of the life cycle of the product or the material. Article 4 provides for the establishment of a Committee at the Ministry of Environment to manage and implement the responsibility system, with the following main tasks (i) approving the implementation of the national mechanism for the control of waste packaging materials; (ii) determining the costs of managing packaging materials waste for the registered entities; (iii) determining the amounts that will be paid based on the weight and type of packaging materials resulting from the goods placed in the market; (iv) determining the terms of reference for bidding for waste management service providers; (v) establishing the necessary incentive systems to motivate consumers to sort at the source and place the sorted waste in the places designated for it; (vi) determining the distribution points of the target packaging waste collection. The Instructions also provide for the establishment of an independent Unit, under the supervision of the Committee, responsible for managing and implementing the producer responsibility system (art.5). Duties of waste management service providers are dealt with in article 6. Obligations of producers and importers are the subject of article 7. Article 8 specifies the packaging materials object of these Instructions. The Ministry of Environment shall monitor the implementation of the system and the concerned activities, and the extent of their application (art.12). A separate bank account shall be established to transfer the amounts paid by producers and importers registered with the unit.
