Résumé

The By-laws provide that the council shall prepare an environmental action plan for the area under its jurisdiction and shall consult the inhabitants of the area, relevant government departments, the Ward Assembly in the area, and other interested stakeholders, in the development of the action plan. Where the plan sets aside an area of the council for grazing, the plan shall specify the number of livestock which may be grazed in that area, persons who may graze livestock, apropriate measures for the conversion and proper use of any animals in the grazing area, etc. Similarly, where an area is set aside for cultivation, the plan should specify which persons may cultivate the area, the type of crops to be grown, area to be set aside as wood lots, the means which may be used to cultivate in any cultivation area, among others. For plans which set aside areas for environmental and natural resources conservation, the plan shall specify areas to be set aside as wood lots, areas for growing renewable energy lots, the measures that may be taken to protect and conserve the environment and natural resources, among others. The By-laws provide that environmental impact assessment reports and certificates in respect of areas mapped out for projects must be registered to the council. There are provisions which grant powers to the council to create measures with respect to burning of vegetation, preventive invasive species, protect wetlands, reduce the cutting of trees, among others. The By-laws give a duty to individuals within an area to protect and conserve water resources and sources within the particular area by preventing water pollution and encouraging sustainable use. The By-laws also provide extensively on air pollution, waste and waste management.
