Governmental Regulation No. 1281-H “On international trade in endangered wild fauna and wild flora species regulated by Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) on the procedure for issuing permits (certificates) for export and import of endangered species, and validating the application forms and forms permits (certificates).

This Regulation enters into force on the tenth day following the day of its official publication.
Résumé

This Regulation establishes that export from the territory of the Republic of Armenia and import into the territory of the Republic of Armenia of wild animals and plants, their parts and derivatives in accordance with the requirements established by the provisions of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) are authorized in the presence of permits (certificates) issued by the Ministry of Environment of the Republic of Armenia in accordance with the form validated by this Governmental Regulation. CITES permits are provided: (a) for export and re-export of samples for a maximum period of 6 months; (b) for export and re-export of samples of mobile exhibitions, zoos and circuses for a maximum period of 36 months; and (c) for the import of the samples specified in sub-clauses 1 and 2 of this clause, for a maximum period of 12 months. A separate permit is issued for each shipment of samples. CITES permits that have not been used within the time limits shall be cancelled and subject to mandatory return to the Ministry of Environment of the Republic of Armenia. Natural and legal persons, including citizens of foreign states and foreign legal persons, submit an application to the Ministry of Environment of the Republic of Armenia to obtain a permit for the export of samples included in CITES Annexes NN 1, 2 and 3 from the territory of the Republic of Armenia. CITES permits for the export of samples are provided in the presence of a positive conclusion issued by the competent scientific body. The Ministry of Environment of the Republic of Armenia issues the appropriate export permit to the applicant within 2 days after receiving the notification or informs in writing about the reasons for rejecting the application. In order to obtain import permits for samples included in CITES Annex No. 1, the applicant submits an application to the Ministry of Environment of the Republic of Armenia in accordance with the validated form. A copy of the contract signed between the exporter and the importer or other contractual document certifying the given import shall be attached to the application, except for the cases when the sample to be transported is the property of the carrier of the given sample. For the purpose of registration of CITES permits issued by the Ministry of Environment of the Republic of Armenia, names and addresses of natural and legal entities importing and exporting, types and quantities of exported and imported samples, names of countries of export and import, and, if possible, also the size and gender of the samples, shall be registered by the Ministry of Environment of the Republic of Armenia, which maintains the register. CITES permits are completed in Armenian and one of the three working languages of CITES (English, French or Spanish). This Governmental Regulation also sets forth the procedure for labelling and packaging of sturgeon caviar exported and re-exported from the territory of the Republic of Armenia, and sold in duty-free shops and in the territory of the Republic of Armenia. Labelling of sturgeon caviar packaging containers enables the identification of the caviar producer and the batch of caviar. The labelling must be visible, legible and indelible. If the containers are opened, the label should be damaged. Labels must contain the following information: (a) sturgeon type standard code according to the table of this order (for example, in the case of caviar obtained from the Siberian sturgeon type - BAE); (b) the source code of the sturgeon from which the caviar was obtained (in the case of sturgeon reared in free-range conditions: C, in the case of wild-caught sturgeon: W); (c) the two letters of the ISO code of the Republic of Armenia (AM); (d) the year of production of caviar; (e) sturgeon caviar producer registration number (xxxx) in the CITES register; and (f) identification number (yyyy) of a batch of sturgeon caviar (certain quantity of sturgeon caviar produced in the same way, processed in the same way, in the same type of containers (glass or metal cans or boxes), from the same manufacturer, from the same packer).
