Résumé

This Governmental Decision establishes: (a) the scheme for trading greenhouse gas emission certificates to promote the reduction of greenhouse gas emissions in an economically efficient way; and (b) increasing the level of emission reduction of greenhouse gases, so as to contribute to achieving reduction levels considered necessary from a scientific point of view to avoid dangerous climate changes. This decision applies to emissions from the activities provided in Annex 1 and greenhouse gases provided in Annex 2. To obtain the authorization regarding greenhouse gas emissions, the operator submits to the National Agency for Environmental Protection the request for obtaining the authorization together with the listed documentation. The request for obtaining the authorization regarding greenhouse gas emissions is accompanied by a non-technical summary of the submitted documentation. The operator has the obligation to ensure to the competent authority for environmental protection the correctness of the submitted information. The National Agency for Environmental Protection issues/reviews, as the case may be, the authorization regarding greenhouse gas emissions for all or part of the facility, if the operator meets the monitoring requirements and the reporting of greenhouse gas emissions. The authorization regarding greenhouse gas emissions may cover one or more installations in which one or more activities provided for in Annex 1, located on the same site, and which are operated or controlled by the same operator. The authorization regarding greenhouse gas emissions contains: (a) the name and address of the operator/name and headquarters, as the case may be; (b) a description of the activities and gas emissions with greenhouse effect generated by the installation; (c) the requirements for monitoring and reporting greenhouse gas emissions corresponding to the plan for monitoring and reporting greenhouse gas emissions approved by the National Agency for Environmental Protection; and (d) the obligation to return, by April 30 of the year following the year for which greenhouse gas emissions were monitored, an equal number of greenhouse gas emissions certificates with the total number of emissions from the respective installation. Greenhouse gas emission certificates are allocated free of charge for the production of thermal energy or cooling agent in centralized heating systems, as well as in high-efficiency cogeneration plants as a form of the promotion of cogeneration based on the demand for useful thermal energy, for a demand justified from an economic point of view. The allocation of free greenhouse gas emissions certificates is prohibited of a facility that has ceased operation.
