Résumé

The National Regulatory Authority for Public Utilities Community Services is empowered, as the competent authority, to grant, modify, suspend, withdraw licenses or withdraw permission to provide service/activities in an administrative-territorial unit for: (a) public water supply and sewage service; (b) public water supply service; (c) public sewerage service; (d) the public sanitation service of localities; and (f) the public service of thermal energy supply, except for the production of thermal energy in cogeneration. This Regulation establishes: (a) the general conditions regarding the granting of licenses that are under the competence of the National Regulatory Authority for Public Utilities Community Services; (b) the procedure for requesting and granting licenses; (c) the conditions under which the licenses granted and the conditions associated with them are modified; (d) the procedure for suspending and withdrawing licenses, as well as withdrawing the permission to render/provide the service/activity in an administrative-territorial unit; and (e) the fees for granting licenses and the annual fees for maintaining licenses, charged by the National Regulatory Authority for Public Utilities Community Services from applicants, respectively license holders. The specific activities of the public water supply and sewerage service, for which the National Regulatory Authority for Public Utilities Community Services (A.N.R.S.C.) grants licenses, under the terms of this regulation, are the following: (a) capture of raw water; (b) raw water treatment; (c) abstraction and treatment of raw water; (d) transport of potable and/or industrial water; (e) water storage; (f) distribution of potable and/or industrial water; (g) collection, transport and evacuation of waste water from users to treatment plants; (h) purification of waste water and discharge of purified water into water reservoir; (i) collection, evacuation and adequate treatment of waste from rainwater drains and ensuring their functionality; (j) evacuation, treatment and storage of sludge and other similar waste derived from the activities of the public sewerage service; (k) drainage of rainwater and surface water from the urban areas; and (l) potable water supply.
